Terms of Service and Privacy Policy

With the arrival of QuickTicket, our new fare payment system, we are providing terms of service for our customers. While many of the changes address the new interactions, we will have with customers through QuickTicket, these updates apply to all interactions you may have with WeGo online.

Below, you will find our full terms of service. By using our services, you agree to be bound by these Terms of Service.

  1. General Terms

These Terms of Service cover your use of all of WeGo’s electronic services, including services offered through WeGo’s website, QuickTicket management portal, mobile applications (“apps”), and other related electronic services (collectively, “Services”). These Terms of Service form a legal agreement between the customer and WeGo.

By using WeGo’s services (even if you don’t setup a QuickTicket account), you agree to be bound by these Terms of Service.

These Terms of Series apply to all Services. Additional terms apply to specific Services, and those additional terms are described below in Section II (“Specific Service Terms”).

By accessing the Services on any computer, mobile phone, tablet, console, or other devices, or through use of an electronic fare card, you signify that you have read, understand, and agree to be bound by these Terms of Service, whether or not you are a registered Services user. We have the right to change these Terms of Service at any time. We agree to post a notice of the changes in the footer of our websites, and the changes will be effective 30 days after posting such notice to our website. Your continued use of the Services shall be considered your acceptance to the revised Terms of Service. If you do not agree to these Terms of Service, please do not use any of the Services.

The Services are not a forum for public communication and debate, but a means for WeGo to provide information relating to WeGo services, programs, objectives, missions, and projects to the public and its customers.

You agree to our use of your personal information and content in accordance with our Privacy Policy, which is incorporated herein by reference. Please note that WeGo is a public agency and is subject to public records laws.

  1. Setting up a QuickTicket account

A customer’s account may be created by the individual, by an employer, educational institution, WeGo staff, or another group. If a customer has an account with another group, that group may have its own terms that apply to the customer’s use of their account.

You may need to setup an account before using some of the Services. A customer may create their own account, or an account may be assigned to a customer by an administrator, such as an employer or educational institution. If a customer is using an account assigned to them by an administrator, different or additional terms may apply. An administrator may be able to access or disable a customer’s account.

The customer is responsible for any activity that occurs under their account. Keep an account username, phone pin, and password secure and do not allow anyone else to use them to access the Services. WeGo is not responsible for any loss that results from the unauthorized use of your username and password, with or without a customer’s knowledge.

  1. Intellectual Property

Our trademarks, service marks, logos and copyrights belong to WeGo and cannot be used without our written permission.

All content included on or through the Services, such as text (including social media posts, schedules, arrival information, fare information), graphics (including maps), designs, logos, presentations, videos, data, instructions, photos, and software (the “Materials”), is the property of WeGo or its licensors. The Materials are protected by copyright, trademark, and other intellectual property laws.

“QuickTicket” and other trademarks, service marks, and logos that we use are property of WeGo. Third-party trademarks that appear in connection with the Services are the property of their respective owners. A customer may not use any of the trademarks displayed in connection with the Services without the express written permission of WeGo and the third party.

  1. Limited License

We are granting the customer a license to use our Services. This means a customer can’t sell, reverse engineer, circumvent or collect anything about users or our services that isn’t permitted.

WeGo grants a personal, United States, royalty-free, non-assignable, and non-exclusive license to use the Materials provided to the customer by WeGo as part of the Services. When a Service requires or includes downloadable software (such as apps), WeGo grants a personal, United States, royalty-free, non-assignable, and non-exclusive license to download the software onto a personal mobile device. These licenses are for the sole purpose of enjoying the Services and are subject to the license restrictions below.

Unless laws prohibit these restrictions or a customer have our written permission, a customer may not:

  • Copy, modify, distribute, sell, or lease any part of our Services or included software;
  • Reverse engineer or attempt to extract the source code of our software;
  • Download, print, copy, distribute, or otherwise use Materials for commercial purposes, including commercial publication, sale, or personal gain;
  • Use any manual process or robot, spider, scraper, or other automated means to collect information or Materials from the Services or from users of the Services;
  • Circumvent any of the technical limitations of the Services or interfere with the Services, including by preventing access to or use of the Services by our other users;
  • Change or remove any copyright, trademark, or other proprietary notices, including, without limitation, attribution information, credits, and copyright notices that have been placed on or near the Materials; or

Impersonate any person or entity or misrepresent yourself or your entity in connection with the Services, or attempt to use another user’s account without the user’s permission.

  1. Third-Party Services

The Services may contain links to websites, applications, or other products or services operated by other companies (“Third-Party Services”). WeGo is not responsible for third-party websites or services.

All decisions as to the placement of links to external sites or pages from the Services will be made by WeGo in its sole discretion. WeGo is not responsible for and does not endorse the content of any third-party website or service. Third-party websites are governed by the separate terms and privacy practices of such third parties. You access such Third-Party Services at your own risk. In the case of third-party apps, we list or link to them merely as a convenience to our users, and WeGo does not sponsor or endorse these apps. We expressly disclaim any liability for these Third-Party Services.

  1. User Content

If you submit any content or feedback to WeGo, the customer gives WeGo the right to publicly display that feedback. The customer represents and warrants that their user content does not and will not violate these Terms of Service or the rights of any third party, including infringing or misappropriating any third-party intellectual property and publicity rights or violating the privacy rights of another person. The customer is solely responsible for their user content. We have no liability for content supplied by a customer or other users.

A customer’s feedback and participation is important to us. With respect to any content a customer submits or makes available to WeGo (including through our “Contact Us” pages and social media channels), such as your biography, comments, suggestions, pictures, videos, and other content, the customer grants to WeGo a non-exclusive, perpetual, worldwide, royalty-free, transferable license to use, copy, distribute, publicly display, modify, and create derivative works from such content. The rights a customer grants in this license are for the limited purpose of operating, promoting, and improving our Services, and to develop new Services. This license continues even if a customer stops using our Services. The personal information we collect from a customer is subject to WeGo’s Privacy Policy.

If a customer submits or posts any creative suggestions, proposals, or ideas about our products and services, the customer agrees that such submissions will be automatically treated as non-confidential and non-proprietary. We may use a customer’s feedback without any obligation or credit to them.

  1. User Content Is Not Prescreened

We do not prescreen content posted by users and cannot guarantee the Services or user content will be free from content that is inaccurate, deceptive, offensive, defamatory, unlawful, or otherwise objectionable. You acknowledge that we are acting only as a passive channel for such distribution. We have no liability relating to any user content or activities of users through the Services. Even in the event we choose to monitor any user content, we assume no responsibility for, or any obligation to monitor or remove such user content.   1. Links to Our Website

WeGo permits links from other websites in accordance with the following conditions:

  • The appearance, position, and other aspects of the link may not be such as to damage or dilute the goodwill associated with WeGo’s name and trademarks or be displayed in any manner that is likely to cause confusion among the public or disparage or discredit WeGo;
  • The appearance, position, and other attributes of the link may not create the false impression that an organization or entity is sponsored by, affiliated with, or associated with WeGo or that views expressed on the website are those of WeGo. WeGo reserves the right to require that the linking website include a notice stating that it is an unofficial website and is not endorsed by, sponsored by, or affiliated with WeGo and that any views expressed on the website are not those of WeGo.
  1. Termination

We reserve the right in our sole discretion to (i) suspend or terminate a QuickTicket account, (ii) delete any or all of user content, (iii) restrict use of all or any part of the Services, and (iv) modify or discontinue any part of the Services, for any or no reason, without notice, and without liability to a customer or anyone else. We also reserve the right to block users from accessing the Services by using any technology available, such as blocking certain IP addresses or device numbers. Any accounts suspended may petition WeGo for reinstatement on a case-by-case basis.

If a QuickTicket card is terminated within five (5) years after card purchase or value was added to a card, then the unused balance on the card will be refunded to the customer.

  1. Your Representations and Warranties

The customer represents and warrants that: (i) they are 18 years of age or older; (ii) they have provided accurate and current information about themselves; (iii) they are eligible to use the Services and have the right and power to enter into these Terms of Service; (iv) they will comply with all federal, state, and local laws; (v) they will not use the Services, directly or indirectly, for any fraudulent undertaking or in any manner that interferes with the operation of the Services; and (vi) they will comply with these Terms of Service.

  1. Warranty Disclaimer

These sections limit our liability. This includes a legal warranty disclaimer, limitation on our liability, and an indemnity clause. The customer should review these limitations.

Although WeGo strives to provide Materials that are both useful and accurate, the nature of the data and other information available through the Services is subject to frequent change. Accordingly, the Materials may not always be up-to-date, accurate, or complete.

The Services and Materials are provided “as is,” “as available,” and without warranties of any kind. Customers use the Services and Materials at their own sole risk. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express, implied, or statutory, including, without limitation, implied warranties of title, quality, performance, merchantability, fitness for a particular purpose, accuracy, and non-infringement, as well as warranties implied from a course of dealing or course of performance. WeGo does not warrant that the Services or Materials will be continuous, prompt, secure, or error-free. WeGo assumes no liability for any errors or omissions, including the inaccuracy of content or for any damages or losses that a customer or any third party may incur as a result of the unavailability of the Services. WeGo assumes no responsibility, and shall not be liable for, any damages to a customer’s equipment, devices, or other property arising from their use of the Services.

  1. Limitation of Liability; Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WeGo AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SERVICES PROVIDERS, AND LICENSORS SHALL NOT BE LIABLE TO A CUSTOMER OR ANYONE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOST PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (REGARDLESS OF WHETHER WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES), HOWEVER, CAUSED, WHETHER BASED ON OR UPON CONTRACT, NEGLIGENCE, STRICT LIABILITY IN TORT, WARRANTY, OR ANY OTHER LEGAL THEORY, ARISING OUT OF OR RELATED TO (i) THE USE OR THE INABILITY TO USE THE SERVICES OR ANY ERRORS, OMISSIONS, OR INACCURACIES IN ANY MATERIALS AVAILABLE THROUGH THE SERVICES; (ii) THE CONDUCT OF OTHER USERS OR THIRD PARTIES; (iii) THE PERFORMANCE OF THE PRODUCTS AND SERVICES PURCHASED THROUGH THE SERVICES; (iv) UNAUTHORIZED ACCESS TO OR ALTERATION OF CUSTOMER DATA, CONTENT, OR PERSONAL INFORMATION; (v) ANY BUGS VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICES; (vi) OR ANY OTHER MATTER RELATING TO THE SERVICES OR ANY PRODUCTS OR SERVICES MADE AVAILABLE THROUGH THE SERVICES.

WeGo’S SERVICES MAY BE USED BY A CUSTOMER TO REQUEST AND SCHEDULE TRANSPORTATION OR LOGISTICS SERVICES WITH THIRD-PARTY PROVIDERS. WeGo HAS NO RESPONSIBILITY OR LIABILITY TO A CUSTOMER RELATED TO ANY TRANSPORTATION OR LOGISTICS SERVICES PROVIDED TO THEM BY THIRD PARTIES. PLEASE REVIEW THEIR TERMS OF USE AND PRIVACY PRACTICES BEFORE USING THEIR SERVICES.

IN NO EVENT SHALL WeGo’S TOTAL LIABILITY TO THE CUSTOMER IN CONNECTION WITH THE SERVICES FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED $500.

  1. Indemnity

The customer agrees to defend, indemnify, and hold harmless WeGo and its officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to a customer’s violation of these Terms of Service or their use of the Services, including, without limitation, a customer’s user content or any use of the Materials other than as expressly authorized in these Terms of Service.

  1. Electronic Communications

By using the Services, a customer agrees to receive certain electronic communications from us, whether through the Services or by email. If a customer signs up for service updates, they agree that we may send them email message updates. A customer may unsubscribe or opt out from certain communications at any time by clicking the appropriate link in the communication. A customer agrees that any notice, agreement, disclosure, or other communication that we send electronically will satisfy any legal communication requirements, including that such communications be in writing. All calls, emails, and other communications between a customer and WeGo may be recorded and stored. All such communications from a customer shall be treated as user content hereunder.

  1. Specific Service Terms

QuickTicket lets a customer pay for their fare on WeGo local fixed-routes buses, regional fixed-route buses, the Star regional commuter train, and paratransit services.

QuickTicket cards don’t have to have accounts associated with them but setting up the account gives the customer the benefit of certain functions like balance protection and automatic reloading. A customer can register at QuickTicketTN.com or by using the mobile app. The mobile app is available for download in the Apple Store, Google Play, or wherever you get your apps. Although the general Terms of Use above apply to all of WeGo’s electronic Services and Materials, these additional specific service Terms of Use apply to the Services identified below:

  1. QuickTicket Fare System

QuickTicket electronic fare system allows a customer to pay their fare by tapping their QuickTicket card, an organizational identification badge, or scanning their mobile phone on the reader. These additional specific Terms of Use apply to a customer’s use of QuickTicket card and mobile app.

  1. Account Setup

If you purchase a QuickTicket card at a retail location, no account setup is required to redeem the fare or check the balance of the card. However, in order to access and use certain functions of QuickTicket mobile app, a customer will need to setup an account. A customer may also setup an account through the QuickTicket website at QuickTicketTN.com. Account setup is required if a customer wishes to (i) reload value on their card online or through the mobile app, (ii) protect their card’s balance against loss or theft, (iii) manage their account, or (iv) automatically reload fare and passes.

If a customer chooses to register their QuickTicket card (including cards provided to them by your employer, an educational institution, or other entity), the card’s serial number will be linked to their account.

These are details about some of the different options for adding money onto your QuickTicket card, including automatic reload.

  1. Loading Value

A customer may purchase QuickTicket reloadable cards–and add value to the cards–at supermarkets, convenience stores, pharmacies, and other retailers. A customer selects the amount of value to load, which must be an amount between $5.00 and $500.00. After initial purchase, customers with accounts set up may load additional value via the QuickTicket website or app. Anyone may load additional value by visiting WeGo Central’s Customer Information Window located at 400 Dr. Martin L. King, Jr. Boulevard in downtown Nashville or at one of our many ticket vending machines at Central and at rail stations.

QuickTicket cards are not, and do not represent, “accounts” or “deposits” and QuickTicket cards are not “money.” They simply represent a prepaid transportation fare. A customer may not redeem QuickTicket cards for money or any product or service other than the applicable Services.

AFTER FIVE (5) YEARS OF NON-USE, A CUSTOMER’S QUICKTICKET CARD WILL AUTOMATICALLY EXPIRE, AND THE UNUSED BALANCE WILL BE REMOVED AND RETAINED BY WEGO. FOR PURPOSES OF THESE TERMS, “USE” OF A QUICKTICKET CARD INCLUDES PURCHASING, REDEEMING OR ADDING VALUE TO THE CARD.

SALES OF QUICKTICKET CARDS AND ANY VALUE LOADED ONTO A QUICKTICKET CARD ARE FINAL AND NON-REFUNDABLE.

  1. Automatic Reloading

A customer may choose to enable automatic reloading of value to their QuickTicket card by logging into their account, specifying the value to add when the account balance drops below a defined threshold. If a customer enables automatic reloading, they authorize WeGo to automatically charge their preferred payment method the amount that they have selected on the schedule they have selected. A customer may opt out of automatic reloading at any time by changing their account preferences.

  1. Redeeming Electronic Fares on WeGo Buses and Trains

A customer can find card readers on board WeGo buses and at WeGo Star rail stations. To redeem a fare, a customer must tap or scan their QuickTicket card, smartphone mobile app, or organizational identification card at the card reader. Customers must tap their card or scan the app every time they board a transportation vehicle.

QuickTicket fare media (including reloadable cards, the mobile app, and non-reloadable tickets) are non-transferrable and may not be shared between multiple individuals. Only one person is permitted to ride using any given QuickTicket media. WeGo reserves the right to disable the fare media of any individual found violating this Term of Use.

If a customer loses their QuickTicket card and they have an account set up, let us know right away to protect their balance. The balance on cards not associated with an account are not protected.

  1. Redeeming Electronic Fares on WeGo Access Paratransit

To use QuickTicket to pay for trips on Access, an Access customer must first link the QuickTicket card number to the Access Customer’s ID number. This can be done online through the QuickTicket web portal, in-person at WeGo Central’s Customer Information Window, or by calling customer care. Once this is complete, every time an Access trip is booked with WeGo, the appropriate fare is automatically deducted from the customer’s QuickTicket account. If the customer does not take the trip for any reason (including no-shows), the QuickTicket account will be issued a credit returning the fare to the customer.

Please note that QuickTicket is not currently supported for the Access-on-Demand premium service for Access-eligible customers, as trips on this program are booked and paid for directly through the customer’s provider of choice. Customers may set up recurring payment accounts directly with a given provider independent of the QuickTicket system.

  1. Lost, Stolen and Damaged Cards

WeGo expects the customer to take reasonable precautions to protect against lost, stolen, or damaged cards. However, we recognize that accidents happen. If a customer has set up an account for their QuickTicket card, they can report their card lost, stolen, or damaged and then WeGo can transfer their balance from the lost card to a new card a customer purchases.  QuickTicket cards not associated with an account do not have balance protection.

  1. Your Responsibilities

The customer is solely responsible at all times for proper redemption of fares and maintaining proof of fare payment in accordance with the rules of WeGo Public Transit. A customer will be subject to penalties, including, but not limited to, citation and exclusion, for failure to exhibit proof of fare payment.

  1. Online Sales of Reloadable cards and Non-reloadable tickets

If a customer purchases and orders non-reloadable tickets online, there will be a shipping and handling charge added to their order. This value will be reflected in the orders total and may change depending on the quantity of tickets purchased. Tickets are sent via U.S. Postal Service.

The specific terms below apply to WeGo’s online sales QuickTicket reloadable cards or non-reloadable tickets.

  1. Shipping Time

Please allow 10 business days for delivery.

  1. Pick-Up Orders

Please allow 48 hours for processing when ordering QuickTicket reloadable cards or non-reloadable tickets online to be picked up at WeGo Central, 400 Dr. Martin L. King, Jr. Boulevard.

  1. No Refunds

Fares are non-refundable.

IF ANY PROVISION OF THESE TERMS IS FOUND TO BE INVALID OR UNENFORCEABLE, THEN SUCH PROVISION WILL BE INEFFECTIVE TO THE EXTENT REQUIRED FOR THE REMAINDER OF THESE TERMS TO BE ENFORCEABLE.

Privacy Policy

Definitions

Personal Identifying Information (PII): PII identifies or describes a person or can be directly linked to a specific individual.  Examples of PII include, but are not limited to, a person’s name, mailing address, billing address, business name, alternate contact information (if given), telephone number, email address, fax number, QuickTicket Card serial number, credit or debit card number, security code and expiration date, and information related to a customer’s mobile device and location if a customer uses the QuickTicket Mobile Application (Mobile App).

Aggregate Data or Aggregate Information: Aggregate Data or Aggregate Information is statistical information that is derived from collective data that relates to a group or category of persons from which PII has been obtained or collected. Aggregate Data reflects the characteristics of a large group of anonymous people. The QuickTicket Agencies may use Aggregate Data and provide Aggregate Data to others to generate statistical reports for the purpose of managing the QuickTicket Card and the QuickTicket Agencies’ QuickTicket program operations.

Overview

WeGo Public Transit (WeGo) and the QuickTicket Participating Transit Agencies (collectively, the “QuickTicket Agencies”) are committed to ensuring QuickTicket customer privacy and security. Specifically: (1) the QuickTicket Agencies will not provide PII from QuickTicket Accounts to any third party without express customer consent, except as described in this Privacy Policy; (2) PII from QuickTicket Accounts will not be provided to advertisers for their use; and (3) the QuickTicket Agencies will maintain a secure environment for customer PII.

This Privacy Policy is intended to provide an understanding of how the QuickTicket Agencies handle PII collected by QuickTicket Agencies. Among other things, this Privacy Policy explains the types of information collected from QuickTicket customers and specifies the third parties with whom the QuickTicket Agencies and INIT (the “QuickTicket Contractor”) may share this information.

The QuickTicket Contractor operates the QuickTicket Customer Service Center and the QuickTicket Call Center. The QuickTicket User Agreement provides that by enrolling in QuickTicket and using the transit systems, a customer allows the QuickTicket Agencies, the QuickTicket Contractor, and other third parties referenced herein to process PII according to the provisions set forth in the QuickTicket User Agreement and this Privacy Policy.

Collection of Personal Identifying Information (PII)

Participating QuickTicket agencies recognizes a QuickTicket whether there is PII associated or not with the QuickTicket card or app. If a customer sets up a QuickTicket Account, the QuickTicket Agencies collect personal identifying information from applications and other forms submitted by QuickTicket customers to the QuickTicket Customer Service Center by telephone, mail, facsimile transmission, in person, or by electronic submission through the QuickTicket website or via the mobile app. The QuickTicket Agencies also consider data developed as a byproduct of a customer’s use of the QuickTicket system (e.g., a user’s travel routes and times traveled) to be PII if a QuickTicket Account is set up.

Additionally, the mobile app may collect certain information automatically, including but not limited to, the type of mobile device being used, a mobile device’s unique device ID, the IP address of a mobile device, the type of mobile operating system, the type of mobile Internet browsers used on the mobile device, and information about the way a customer uses the mobile app. When a customer uses the mobile app, the QuickTicket Agencies may use GPS or other similar technology to determine a customer’s location to provide certain services available via the mobile app. If you do not want your location being used for such purposes, you should turn off the location services for your mobile device in your account settings.

How the QuickTicket Agencies Use Personal Identifying Information

The QuickTicket Agencies use PII provided by customers to provide services through the QuickTicket website and mobile app to effectively and efficiently process enrollments, manage accounts, respond to questions, send customer emails about QuickTicket program updates, and otherwise communicate with QuickTicket customers.

PII is only utilized as described in this Privacy Policy.

Third Parties with Whom the QuickTicket Agencies May Share Personal Identifying Information

The QuickTicket Agencies may share PII with any current or future QuickTicket Agencies for the purpose of operating and managing the QuickTicket program. The QuickTicket Agencies may also disclose PII to the Greater Nashville Regional Council (GNRC), Tennessee Department of Transportation (TDOT), and Federal Transit Administration (FTA). If another transit agency or party is added to the QuickTicket program, the QuickTicket Agencies will notify their customers via amendment to this Privacy Policy and on the QuickTicket website. In addition, the QuickTicket Agencies may disclose PII to third party service providers for the purpose of operating and maintaining the QuickTicket system, such as managing customer accounts and collecting revenue. Any such contractors are provided only with the PII they need to deliver the service being provided. The QuickTicket Agencies require service providers to maintain the confidentiality of the information and to use it only as necessary to carry out their duties under the QuickTicket program.

The QuickTicket Agencies require outside law enforcement and regulatory agencies to obtain a subpoena for QuickTicket records containing PII, including location data, unless otherwise required by law, or the law enforcement or regulatory agency articulates the existence of a bona fide emergency requiring immediate access to specific records. Additionally, the QuickTicket Agencies may disclose PII without request to appropriate law enforcement agencies where necessary to protect their or their customers’ rights, property or safety.

The QuickTicket Agencies may provide a QuickTicket customer’s PII to a third party as necessary to process any retail transaction using a QuickTicket Card that a customer may conduct with retail merchants other than any of the QuickTicket Agencies. As with any credit or debit card payment, if a QuickTicket customer conducts a transaction with a retail merchant using the mobile app, or any other QuickTicket program media, the QuickTicket Agencies need to share some information (for example, the customer’s name and credit or debit card number) with the banks and other entities in the financial system that process credit or debit card transactions. The QuickTicket Agencies are not responsible for third party use of PII provided to retail merchants at which customers use the mobile app or any other QuickTicket program media to conduct transactions, regardless of whether the transaction was conducted in person or online by the QuickTicket customer.

Besides these entities, PII will not be disclosed to any other third party without express customer consent, except as required to investigate and respond to consumer complaints and to comply with laws or legal process served on any current or future QuickTicket Agencies or the QuickTicket Contractor.

Retention of Personal Identifying Information

The QuickTicket Agencies, through the QuickTicket Contractor, will only store the PII of a QuickTicket customer that is necessary to perform account functions such as billing, account settlement, or enforcement activities. All PII will be discarded no later than four years after a QuickTicket Account is closed or terminated.

Security of QuickTicket Personal Identifying Information

The QuickTicket Agencies are committed to the security of customer PII. The QuickTicket Agencies, together with the QuickTicket Contractor, store the PII provided by QuickTicket customers on secure computer servers, which are designed to prevent unauthorized access.

Access to PII is controlled through administrative, technical, and physical security measures. Third parties with whom the QuickTicket Agencies share PII are also required to implement adequate security measures to maintain the confidentiality of such information.

QuickTicket Customer Obligations and Legal Disclaimer

QuickTicket customers are responsible for safeguarding personal mobile devices, usernames, passwords, personal identification numbers (PINs), and other authentication information that may be used to access a QuickTicket account. QuickTicket customers should not disclose authentication information to any third party and should notify the QuickTicket Agencies of any unauthorized use of their usernames, passwords or accounts. The QuickTicket Agencies cannot secure PII that is released by QuickTicket customers to others or PII that customers request the QuickTicket Agencies release to others. The QuickTicket Agencies are not responsible for any data or PII obtained by a third party as a result of a QuickTicket cardholder’s negligence or misuse of QuickTicket fare media, products, or equipment.  If a QuickTicket cardholder’s fare media is lost, stolen, or damaged, the QuickTicket Agencies are not responsible for any data or PII that is obtained by a third party until the problem is reported to the QuickTicket Agencies.

Account Access and Controls

Setting up a QuickTicket Account is at the customer’s discretion. The information required to set up an account or to obtain other convenience benefits provided by QuickTicket includes PII such as name, mailing address(es), billing address, email address, telephone number, and, for certain convenience benefits, credit or debit card number, expiration date and QuickTicket account security code. The QuickTicket Agencies may request other information as required by law.  The QuickTicket Agencies also may request other optional information, such as alternate contact information, but in such instances the QuickTicket Agencies will indicate that providing such information is optional.

Customers who have set up a QuickTicket Account can review and update personal information at any time, and are also able to modify, add, or delete any optional account information. PII and optional account information can be reviewed and edited as discussed below under “Updating Personal Identifying Information.” QuickTicket customers can close their account at any time by contacting QuickTicket Customer Service at 615-862-5950 or by disabling their account online at QuickTicketTN.com or in the mobile app. All account information will be deleted no later than 4 years after an account is closed or terminated by the customer or left inactive for a period of two years.

Aggregate Data

The QuickTicket Agencies may also combine the PII provided by QuickTicket customers in a non-identifiable format with other information to create Aggregate Data that may be disclosed to third parties. Aggregate Data is used by the QuickTicket Agencies to improve the QuickTicket program and for the marketing of QuickTicket. Aggregate Data does not contain any information that could be used to contact or identify individual QuickTicket customers or their accounts. For example, the QuickTicket Agencies may inform third parties regarding the number of QuickTicket accounts within a particular zip code. The QuickTicket Agencies prohibit third parties with whom Aggregated Data is shared from attempting to make the information personally identifiable.

Cookies

The QuickTicket website, www.QuickTicketTN.com, stores “cookies” on the computer systems of users of the website. Cookies are small data elements that a website can store on a user’s system.

The cookies used by the QuickTicket web site facilitate customers’ use of the website (e.g., by remembering login names and passwords until the session has ended). The QuickTicket website does not require that users of the website accept these cookies. Additionally, the QuickTicket website does not store third party cookies on the computer systems of users of the website.

If a user visits a third party website via a link provided on the QuickTicket website, the privacy policies of those other websites will apply and should be reviewed to understand how these external sites use cookies and how the information that is collected through the use of cookies on those websites is used.

The QuickTicket Agencies do not knowingly engage in business with any company or vendor that uses Spyware or Malware. The QuickTicket Agencies do not market detailed information collected from web sessions that can be directly tied to PII. The QuickTicket Agencies do not provide QuickTicket customers with downloadable software that collects or utilizes any PII.

Third Party Websites and Applications

The QuickTicket website contains links to third party websites. These web links may be referenced within content or placed beside the names or logos of the other entities. The QuickTicket Agencies do not disclose PII to these third party websites except as described in the QuickTicket Privacy Policy.

WARNING: The QuickTicket Agencies are not responsible for the privacy practices of external websites or applications, regardless of whether they are accessed through a service or content link. Please review the privacy policies of external websites or applications before providing any information to them.

Personal Information of Children Under the Age of 13

The QuickTicket Agencies comply with the requirements of the Children’s Online Privacy Act (COPPA) and the FTC’s Rule interpreting COPPA (16 CFR § 512). The QuickTicket website and the QuickTicket Mobile Application are not directed to children, and the QuickTicket Agencies do not knowingly collect any personally identifiable information from children under the age of 13.

Updating Personal Identifying Information

Customers can review and edit their PII online at www.QuickTicketTN.com, via the mobile app or by calling QuickTicket Customer Service at 615-862-5950.

Complaints or problems regarding updating personal information should be submitted via the QuickTicket website or by contacting QuickTicket Customer Service at 615-862-5950. QuickTicket Customer Service will either resolve the issue or forward the complaint to an appropriate QuickTicket Agency staff member for a response or resolution. The QuickTicket Agencies strive to answer all queries within 48 business hours, but it may not always be feasible to do so.

Changes to the QuickTicket Privacy Policy

The QuickTicket Agencies reserve the right to modify the QuickTicket Privacy Policy at any time. When the QuickTicket Agencies revise the QuickTicket Privacy Policy, the “last updated” date at the bottom of the QuickTicket Privacy Policy will reflect the date of the most recent change. We will post for a period of 30 days notice to customers on the QuickTicket website of changes made to the privacy policy. We encourage QuickTicket customers to review the QuickTicket Privacy Policy periodically. Continued use of the QuickTicket program constitutes the customer’s agreement to the QuickTicket Privacy Policy and any updates.

E-mails Sent to the QuickTicket Agencies

The QuickTicket Privacy Policy does not apply to the content of emails transmitted directly to the QuickTicket Agencies. Please do not send PII in an email directly to the QuickTicket Agencies.
